1. These Terms and Conditions
These terms and conditions apply to all transactions on this site and they do not affect your statutory rights. We may change these terms and conditions at any time. Any changes will take effect on the date they are posted onto the site (see date above). You are required to agree to these terms and conditions each time you place an order.

2. Our Contract
2.1 We shall sell to you and you shall purchase only those goods which you have set out in an order and which have been accepted by us. We reserve the right to reject any order. Unless otherwise agreed in writing each such sale of goods will be subject to these terms and conditions.

2.2 No order submitted by you shall be deemed to be accepted by us unless until confirmed in writing. Once you place an order you will be e-mailed your order number and details of the product you have ordered. These e-mails are an acknowledgement and not acceptance of your order. Acceptance of your order and the creation of a legally binding contract between us will only occur when we send you a "Delivery" e-mail.

2.3 No variation to these conditions shall be deemed to be accepted by us unless and until confirmed by e-mail or in writing by us.

2.4 Any error or omission in any information or document issued by us shall be subject to correction provided that the correction does not materially affect the contract.

3. General
3.1 We endeavor to notify on our website any items that are out of stock wherever possible. If a product ordered is out of stock with our supplier and ourselves we will notify you with the information given to us by the manufacturer or supplier. You should allow us up to 14 days for the dispatch of the goods. If the delay becomes longer than 14 days you will be given the option to cancel the order and we will refund any monies paid by you. We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay in delivering the goods.

3.2 We cannot be held responsible for any inaccurate information given during any telephone conversation of an order. Manufacturers on occasion change specification and offers without notification. It is your responsibility to verify any technical information contained on the website or communicated over the cause of a telephone call, live support session or e-mail communication. Due to the very wide range of products supplied it is suggested that all technical related queries are directed to the manufacturer. Contact details are provided for each product.

3.3 Products, prices and promotions are valid only for the period which they are displayed (unless stated) and are all subject to availability. If any of these should change to your detriment or become unavailable in the period after you placed your order with us, you will be contacted before we proceed with your order.

3.4 In the event that a product is listed at an incorrect price due to a typing error, pricing error from our manufacturer, supplier, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price even if the order has been accepted. We will notify you of the correct price, giving you the opportunity to cancel the order and have a refund of any monies paid if the order is cancelled.

3.5 The purchaser shall have ownership of the goods as soon as delivery has taken place which is after payment in full.

3.6 From the time of receipted delivery of the goods, any loss or damage to the goods shall be at your own risk.

3.7 You can log in and print an electronic invoice once the goods have been dispatched to you.

3.8 These terms and conditions and all transactions relating to this website are governed by Australian law and are subject to the non-executive jurisdiction of the Australian courts. We do not accept amendments to these terms and conditions.

3.9 Your data protection rights are set out in our Privacy Policy.

3.10 Additional terms and conditions only cover the 1stAudioVisual.com.au website. Any other websites to which you link from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites which are not under our control.

4. Payments
4.1 All prices and changes on this site are shown in Australian dollars. Prices shown on product pages are including GST, but NOT Australian delivery charges.

4.2 Refunds completed by us will then generally take 3-4 days to be processed through the banking system. This is outside our control and we apologise for the inconvenience.

5. Delivery
5.1 All deliveries must be signed for by the contact person you provided on your order, with the exception of some small items which may be sent by post. Please make sure you keep the receipt enclosed with your goods.

5.2 We will only deliver goods to the address on the order and goods will not be left without a signature. Various delivery methods are used including Post Mail and reputable 3rd party courier companies.

5.3 If goods arrive in a damaged condition you must sign the delivery note as "refuse" or if you accept the delivery, you must sign for "damaged" and write a brief description of the damage on the note, before informing us within 48 hours from delivery date, quoting your order number.

5.4 It is your responsibility to notify us of any incorrect goods delivered within 48 hours from date of delivery quoting your order number. It is also your responsibility to sign for the correct number of packages as shown on the carriers’ delivery note, any shortages must be noted on the delivery note and you must notify us within 48 hours from the delivery date, quoting the order number.

5.5 We shall not be liable for any losses, costs, damages, charges or expenses caused by any delay of the goods purchased.

5.6 All prices listed are exclusive of a standard delivery. These shall not be more than AUD$100 for small portable items, AUD$200 for 32-42 inch and smaller televisions or monitors, AUD$300 for 50, and AUD$400 for 60 and larger screens. Standard delivery will normally be made within 2-7 working days of clearance of payment.

5.7 Refunded items will be exclusive of delivery so long as it can be shown that delivery was successfully made. Replacements that are not requested in writing within 7 days of purchase will be subject to standard delivery charge.

5.8 Different products in the same order may arrive separately. For example an LCD TV and wall bracket may arrive by two different couriers. In this instance delivery will be said to be made in installments. Each delivery shall constitute a separate contract and any failure by us to deliver any one or more of the installments in accordance with these conditions, or any claim by you in respect of one or more installments will not entitle you treat the contract as a whole as repudiated.

5.9 If we fail for any reason within our control to fully or partially deliver your goods, any reimbursement shall be no more than the price of the goods together with any delivery and or reasonable return costs.

5.10 Each party is entitled to cancel the contract in respect of non-performance of obligations in relation to delivery. If cancelled we will refund you any monies already paid by you subject to conditions in clauses 5.7

6. Limits and Responsibilities.
6.1 Subject to our obligations, and your rights under the regulations, we shall not be liable to you or to be deemed in breach of the contract by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the Goods if the delay or failure was due to any cause beyond our reasonable control.

6.2 We assume no responsibility for the contents of any other web sites to which this web site has links.

7. Installations
7.1 If installation is available, you will be offered it as part of the order process. It may be subject to additional terms and conditions, but includes: Your product unpacked and checked. Product positioned and set up for you. Safe, secure installation. Any unusual product features explained to you. Our installation charge will be on an additional agreement.

8. This Website
8.1 We, our Group companies and our suppliers own the copyright, trademarks and all other intellectual property rights in all material and content on this website, which you may use, download, copy, publish, transmit or otherwise make available by any other means only for your own personal, non-commercial use. Any other use or reproduction of the material or content is strictly prohibited.

8.2 You may not create any link to this website without our prior written consent, nor may you restrict or inhibit the use or enjoyment of it by anyone else.

9. Returned Goods
9.1 A product is deemed to be faulty upon arrival if it shows symptoms of hardware failure preventing its basic operation upon its first use out of the box. You should contact the manufacturers first then you will need to log in to your account and let us know within 7 days of the delivery date and an online RMA form completed in full.

9.2 We strongly advise all customers to retain boxes and packaging where possible as manufacturers may not accept faulty returns that are not in their original packaging.

10. Returns and Refunds
Please provide as much of the following detail as possible in the Reason for Return / Description of Fault box.
Note: Descriptions like "Broken", "Dead", "No Function" will not be sufficient. By filling out as much information as possible, we will be able to quickly diagnose your product's fault and be able to advise you of a solution.

All Products will be tested and by clicking the Submit button, you agree that if your product is found to have no faults, it will be returned to you at the following collection/return Courier Costs (ex GST):
AUD$50 for projectors, DVD players, and other small items
AUD$150 for screens up to 42
AUD$200 for screens up to 55
AUD$300 for larger items
We also reserve the right to charge an administration cost of AUD$50
All manuals, cables, packaging, etc. are to be included in the return and packaging must be in new condition or replacement charges will apply.

You will be notified once your return request has been approved. We will send you additional cover notes to attach to your packaging before sending out the courier for returning the product.

Items Damaged in Transit
If any items are damaged in transit, we ask that you need to log in to your account to report it to us in writing within 48 hours. If the items are visibly damaged on receipt, it's best to sign the carrier's delivery note accordingly, otherwise you should always sign goods as UNCHECKED. Please ensure you detail on your order comments how the goods were signed for and whether there was any visible damage to the box when it arrived. Items must be ready to be returned with their original packaging complete with all accessories and documentation.

Items Faulty on Arrival
If your items are faulty on arrival, claims outside 7 days will not be recognised and goods will need to be repaired through an authorised service centre. Once again should you find yourself in this situation please call us to discuss the best course of action, as it will vary depending on manufacturer. You have 7 calendar days in which to inform us of the fault by log in to your account and complete the RMA form. Items should be returned with their original packaging complete with all accessories and documentation. Once we have verified the fault, we'll issue a replacement or full refund to you via your original payment method and reimburse your reasonable return carriage costs. All returned items are tested by agents of the manufacturer and if a returned item is found not to be faulty by their technicians we will return the item to you. In this instance you will be liable for any collection and return carriage and a possible AUD$50 Administration charge.

Items Faulty in Warranty Period
If any of your purchases develop a fault and it's more than 7 calendar days since receipt, then provided your item is within its warranty period, you are entitled to a warranty repair. All manufacturers provide specialist telephone help facilities for your convenience which we recommend you use in order to correct the fault quickly. We provide the telephone number and website details for most manufacturers on the website.

11. Personal Information
11.1 Information collected by 1stAudioVisual at the time of ordering or registering is lawful and in accordance with the Data Protection Act 1998. We do not sell or pass on customers details to any other business or organisation for any purpose other than for processing your order with us.

12. Complaints
12.1 We pride ourselves on the high standard of service we provide our customers but if you believe you have cause for complaint about a product or service that you have received from 1stAudioVisual please e-mail our customer service department. We will aim to respond to all complaints within 1 working day where possible and then proceed to resolving the problem as soon as possible for you.
